Terms and conditions

These terms apply to every order placed in the online shop at spurlos.ch.

This English translation is provided for convenience only. Only the German version of these terms is legally binding. In the event of any discrepancy, the German version prevails.

1. Seller

SPURLOS Kollektiv, an association within the meaning of Art. 60 et seq. of the Swiss Civil Code (ZGB), Berchtoldstrasse 29, 3012 Bern, Switzerland, hallo@spurlos.ch (hereinafter «we»). The version of these terms published on this page at the time of your order applies.

2. Conclusion of contract

The presentation of products in the shop does not constitute a binding offer. Clicking «Zur Kasse» (checkout) takes you to the payment page of our payment provider Stripe. There you can review and correct your details before completing your order and confirm that you accept these terms. By completing the payment, you place a binding order. The contract is concluded as soon as the payment has been confirmed. You will then receive a confirmation with a receipt by email. If, contrary to expectations, we are unable to deliver a product, we may withdraw from the contract; in that case we will contact you without delay and refund the amount paid in full.

3. Prices

All prices are in Swiss francs (CHF). We are not registered for value added tax; prices do not include VAT. Any shipping costs are shown on the payment page before you pay.

4. Payment

You pay in advance via Stripe. The payment methods shown on the payment page are available, for example credit and debit cards or TWINT. We do not see your payment details.

5. Delivery

We deliver within Switzerland only, by Swiss Post as a letter or parcel. Products in stock are dispatched within 7 working days of payment. If a product is not in stock, we sew it after you order; the delivery time is then stated with the product. If a delivery is delayed by more than 14 days, we will contact you. You may then withdraw from the purchase and will receive a refund of the amount paid.

6. Returns

In addition to your statutory rights, we voluntarily grant you a right of return: you may return unused products in their original packaging within 14 days of receipt. To do so, notify us at hallo@spurlos.ch within this period and then send the goods back within 14 days. You bear the cost of return shipping. Once we have received and inspected the goods, we will refund the purchase price and, if you return the entire order, the original shipping costs within 14 days to the original means of payment. For hygiene reasons, we do not accept returns of used PeeCloths.

7. Warranty

Please inspect the goods upon receipt and report any defects to hallo@spurlos.ch within 14 days, if possible with a photo; defects that only become apparent later must be reported within 14 days of their discovery. The warranty period is two years from delivery. In the case of a justified defect, you may choose whether we repair or replace the product or refund the purchase price in full or in part; in this case we bear the cost of return shipping. Further statutory claims remain reserved within the limits of section 8. Our products are sewn by hand: minor variations in colour, pattern and size are intended and do not constitute a defect, nor does normal wear and tear from use.

8. Liability

We are liable for damage caused intentionally or through gross negligence. We are not liable for slight negligence; this also applies to consequential damage resulting from defects. Liability for personal injury and liability under the Swiss Product Liability Act remain reserved.

9. Data protection

How we handle your data is set out in our privacy policy (spurlos.ch/datenschutz).

10. Applicable law and place of jurisdiction

These terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the City of Bern; mandatory places of jurisdiction for consumers remain reserved.
